1. Introduction

Welcome to Whaily. These Terms of Use govern your access to and use of the Whaily service, a web-based tool for tracking AI search visibility, monitoring brand mentions across AI models, and analysing third-party source influence. By using Whaily, you agree to these Terms. If you do not agree, do not use the service.

2. Nature of the service

Whaily is a personal project, not a commercial product of any company. It is provided on an “as is” and “as available” basis. The service may contain bugs, inaccuracies, or interruptions. There is no guarantee of uptime, data accuracy, or completeness. You use Whaily entirely at your own risk.

3. No liability

To the fullest extent permitted by law, Whaily and its operator accept no liability for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service. This includes, but is not limited to, loss of revenue, loss of data, loss of business opportunity, or reputational damage. You should not rely on Whaily data for critical business decisions, financial decisions, or legal compliance.

4. Data accuracy

AI visibility data, NCI scores, and source rankings are provided for informational purposes only. They represent estimates based on sampling and algorithmic scoring, and should not be treated as definitive measurements. Results may vary due to model updates, regional differences, and prompt sensitivity.

5. Acceptable use

You agree not to use Whaily to track individuals without consent, to engage in automated abuse of third-party services, or for any activity that violates applicable law. The operator reserves the right to suspend or terminate access to any account that violates these terms.

6. Intellectual property

All content, code, and methodology within Whaily, including the NCI scoring system, is the intellectual property of the operator. You are granted a limited, non-exclusive, non-transferable licence to use the service for your own internal purposes. You may not reproduce, distribute, or create derivative works from any part of Whaily without prior written consent.

7. Changes to terms

These terms may be updated at any time. Continued use of Whaily after changes are published constitutes acceptance of the updated terms.

8. Governing law

These terms are governed by the laws of Sweden. Any disputes shall be subject to the exclusive jurisdiction of the Swedish courts.
